The following quoted words will have the meanings explained below in this agreement, unless the content is clearly indicating otherwise:-
- “You”/”Your” means to the person/traveler requesting for services though Magical Destinations Safaris website.
- “The Company”/”We”/”Our”, means Magical Destinations Safaris.
- For a confirmation on our side, the traveler is required to make a deposit of 30% of the total cost of the safari to secure the reservation. The balance payment must be made 40 days prior to the safari commencement. Any additional expenses incurred by the traveler which are not included in the basic cost of the safari, must be paid by the traveler when incurred.
- If a traveler wishes to alter or cancel his/her travel arrangements, the following conditions will be applicable:-
If the cancellation notice is given 60 days or more before the safari commencement date, deposit will be refundable less 10% of the safari cost cancellation fee.
If the cancelation notice is given between 60 to 30 days, an equivalent of 35% of the total safari cost will be charged as the cancellation fee.
If the cancelation notice is given between 29 to 16 days, an equivalent of 50% of the total safari cost will be charged as the cancellation fee.
If the cancelation notice is given between 15 to 0 days, an equivalent of 100% of the total safari cost will be charged as the cancellation fee.
We strongly recommend obtaining a travel cancellation insurance.
- We are a travel agent and a tour operator company. We have no ownership of hotels, lodges or any other accommodation facilities as well as any airlines. We will organize/arrange accommodation/hotel bookings, flight tickets and other travel services only as your agent. Therefore, you are also subject to the additional terms and conditions of the suppliers of the third party services. We are not liable for any damage or loss you may suffer due to acts omissions/ defaults of any such supplier/third party. Whatever way, we will always aspire to contract services of companies which in our discretion deliver the services in the appropriate quality as we adhere with the laws of the land.
- It Before embarking on your safari/trip, it is your responsibility to ensure you have all the necessary travel documents with you, this includes the passport which should be valid for the duration of your trip, a valid visa,e.t.c. Sometimes the visa requirements can change without notice therefore please make sure to check with the appropriate embassy to keep yourself updated.
- All the baggage and personal effects will be the traveler’s risk throughout and if necessary, it’s advisable to be insured against damage or loss for which Magical Destinations Safaris will not be liable of.
- All quoted charges are calculated based on prevailing tariffs and exchange rates are subject to revision according to any fluctuations thereof, which may take place. Subject as otherwise herein specifically provided, all questions affecting the liabilities and rights of the parties under this conditions shall be determined in accordance with the Kenyan laws.
- To ensure your safety and enjoyment of the services you may purchase from us, we will ensure to take all the necessary precautions to make it a success. However, we will not in any way accept any responsibility for injury, delay, death, loss or damage rising from any cause in any manner whatsoever; force majeure; accident, acts of Government; neglect, acts of terrorism, errors or omissions caused by any third party suppliers, their employees or representatives, independent contractors, any event that is beyond our control.
- We reserve the rights to alter any of the above conditions at any given time.
- Travelers must have their own medical insurance cover as we will not provide cover for any medical problem that may occur.
